Should you fight your parking ticket?

Parking tickets do not affect your record

A parking ticket is a non-moving, civil infraction. Your vehicle was parked — it was not in motion. Because of this, parking tickets are treated very differently from traffic tickets:

  • No points on your driving record
  • No impact on your auto insurance premiums
  • No criminal record — a parking ticket is not a misdemeanor or a felony
  • No jail time — you cannot be arrested for receiving a parking ticket
  • No traffic court — parking tickets are handled through local administrative systems, not criminal or traffic courts

In short, a parking ticket is a fine. It does not follow you the way a traffic ticket does.

Why OTR does not fight parking tickets

The main reason people hire an attorney to fight a traffic ticket is to protect their driving record and keep insurance premiums low. A single traffic ticket on your record can increase your insurance by 20–40% for 3 to 5 years — costing far more than the legal fee to fight it.

Parking tickets do not carry these consequences. Since there are no points, no record impact, and no insurance increase, the benefit of hiring an attorney to fight a parking ticket is limited to the fine itself. In most cases, the cost of hiring a lawyer would exceed the fine, making it impractical. And even in the rare case where the fine is larger than the legal fee, fighting is still a gamble — the only scenario where you come out ahead is a full dismissal, and no attorney can guarantee one.

This is not just an OTR policy — most attorneys do not fight parking tickets at all, for the same reasons. If you ever come across an attorney offering to fight your parking ticket, it is worth asking them what advantage there is in doing so.

That is why OTR focuses on tickets and charges that have real, lasting consequences — traffic tickets, DUIs, misdemeanors, and other matters that affect your driving record, criminal record, or insurance.

💡 The difference in a nutshell:

A traffic ticket affects your record and your wallet for years. A parking ticket only affects your wallet once. OTR fights the ones that follow you.

What to do if you get a parking ticket

In most cases, the simplest option is to pay the fine and move on. Unlike traffic tickets, paying a parking ticket does not mean pleading guilty to a criminal or moving violation — it is just settling an administrative fine.

If you want to contest a parking ticket, you can do so on your own through the issuing agency's administrative process. Check the information printed on the ticket for instructions on how to request a review or hearing.

Do not ignore a parking ticket

While parking tickets do not affect your driving record, ignoring them can still cause problems:

  • Escalating fines Late fees can significantly increase the original fine amount
  • Registration hold The issuing agency can place a hold on your vehicle registration, preventing you from renewing it until all fines are paid
  • Vehicle towing or impoundment In some states, accumulating a certain number of unpaid parking tickets (for example, 5 in California) can result in your vehicle being legally impounded. You would need to pay all outstanding fines plus towing fees to get it back

Ignoring a parking ticket will not land you in jail, but it can make your life more difficult and more expensive. Pay it or contest it — but do not let it sit.

When a parking ticket deserves a closer look

In very rare cases, a parking-related offense can be elevated beyond a civil infraction into a criminal offense — for example, intentionally blocking an emergency vehicle or committing an offense in a state park that carries criminal penalties.

And more broadly: if anything about your ticket feels more serious than a standard fine — the citation mentions a criminal statute, the fine seems unusually large, or the circumstances are unusual — do not just pay it and hope for the best. Book a case on OTR and a local attorney will review your ticket right away. If the attorney believes it is worth contesting, we will move forward with your case. If not, we will cancel your case and issue you a full refund. It costs nothing to have an attorney take a look.
